    Terms of Service

    Last updated: October 21, 2026. These terms govern your use of oshaoperator.com and every purchase of training from OSHA Operator.

    1. Agreement to these terms

    These Terms of Service ("Terms") are a binding agreement between you and OSHA Operator ("we", "us", "our"), the operator of oshaoperator.com. By accessing the website, creating an account, or purchasing any course, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the website or purchase training.

    If you purchase seats or assign training on behalf of an employer or other organization, you confirm that you are authorized to accept these Terms on that organization's behalf, and "you" includes that organization.

    2. Who we are — and who we are not

    OSHA Operator is a private training provider. We are not affiliated with, endorsed by, or operated by the Occupational Safety and Health Administration (OSHA) or the U.S. Department of Labor. Nothing on this website is legal advice, and nothing here replaces the text of federal or state regulations.

    3. What our training does and does not cover

    Our online courses provide the formal instruction component of powered industrial truck operator training described in 29 CFR 1910.178(l). Federal regulation also requires practical (hands-on) training and an evaluation of the operator in the workplace. Employers remain responsible for the workplace-specific practical training and operator evaluation required by federal regulation.

    A certificate of completion from OSHA Operator documents that the named person completed our formal instruction course and passed the final exam. It does not, by itself, authorize anyone to operate a forklift, and it does not transfer the employer's compliance obligations to us. The decision to accept any training certificate always rests with the employer.

    The MEWP (Mobile Elevating Work Platform) add-on is a separate theory course sold only together with a forklift seat. It follows the same structure: formal instruction online, with practical evaluation remaining the employer's responsibility.

    4. Accounts and eligibility

    You must be at least 18 years old to create an account or purchase training. You agree to provide accurate information — including the exact legal name that should appear on your certificate — and to keep your login credentials confidential. Accounts are personal: one account per learner, and course progress and exam attempts must be completed by the person named on the account. You are responsible for all activity under your account.

    5. Purchases, pricing and payment

    Prices are shown on the website and at checkout before you pay. Checkout and payment processing are handled by Shopify; we do not see or store your full payment card number. Your purchase is complete when payment is accepted, and course access is linked to the account you create or sign in with.

    Organization seat purchases create a pool of seats the purchaser can assign to operators. Unused seats remain on the account until assigned or refunded under our refund policy.

    6. Refunds and exam retakes

    A full refund is available within 20 days of purchase, and only until your wallet card is printed. Both conditions must hold: after 20 days from purchase, or once your wallet card has been printed — whichever comes first — the order is final. Final exam retakes are always free and unlimited, and are separate from the refund policy. The full policy, including how to request a refund, is on our Refund Policy page, which is part of these Terms.

    7. Certificates, wallet cards and verification

    When you complete the course and pass the final exam, we issue a digital certificate of completion and mail a printed wallet card to the shipping address you provide. You are responsible for providing an accurate name and mailing address. Employers can verify certificates through our public verification tool.

    We may void a certificate, decline to print a card, or disable an account if we reasonably believe the account information is false, the coursework or exam was completed by someone other than the named learner, or the certificate has been altered or misused. Certificates remain the record of our training only — they do not certify the employer's practical evaluation.

    8. Acceptable use

    You agree not to:

    • Share your account, course access, or exam with any other person;
    • Complete coursework or exams on behalf of another person, or allow anyone to do so for you;
    • Copy, record, redistribute, resell, or publish course content, exam questions, or answer keys;
    • Scrape, crawl, or bulk-download the website or its content by automated means, except for good-faith search engine indexing;
    • Interfere with the website, attempt to access other users' accounts or data, or use the site for anything unlawful;
    • Misrepresent your identity, your employer, or your certification status.

    We may suspend or terminate accounts that violate these rules, without refund where the violation is material.

    9. Intellectual property

    The website, course content, exams, graphics, logos, and all related materials are owned by OSHA Operator or its licensors and are protected by copyright and other intellectual property laws. Your purchase gives you a personal, non-transferable, non-exclusive license to access the course for your own training. No other rights are granted.

    10. Feedback and reviews you send us

    If you send us feedback, a review, or a testimonial — for example by replying to a follow-up email or through a survey — you give us permission to display it on the website and in our marketing, together with your name, role, and company as you provided them, unless you ask us to remove it. You can ask us to remove or correct your review at any time by emailing support@oshaoperator.com. We do not pay for reviews and we do not publish feedback we have not received.

    11. Disclaimers

    The website and courses are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

    Without limiting the above: we do not warrant that the website will be uninterrupted or error-free; we do not guarantee employment, job placement, or any employer's acceptance of a certificate; and we do not guarantee any particular regulatory outcome, because compliance obligations belong to employers and depend on workplace-specific factors outside our control. Course content reflects regulations as of the date it was prepared and may be updated as regulations change.

    12. Limitation of liability

    To the fullest extent permitted by law, OSHA Operator and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the website or courses — including any workplace incident, injury, citation, or penalty. Our total liability for any claim relating to a purchase is limited to the amount you paid us for that purchase. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

    13. Indemnification

    You agree to indemnify and hold harmless OSHA Operator from claims, damages, and expenses (including reasonable attorney's fees) arising out of your violation of these Terms, your misuse of the website or courses, or your violation of any law or third-party right. An employer that purchases training is responsible for its own compliance with OSHA training and evaluation requirements.

    14. Third-party services

    Checkout and payment processing are provided by Shopify, and wallet card printing and mailing are fulfilled through shipping carriers. Your use of those services is also subject to their own terms. We are not responsible for third-party websites or services linked from our site, including osha.gov.

    15. Governing law and disputes

    These Terms are governed by the laws of the United States and, to the extent state law applies, the laws of the state in which OSHA Operator is organized, without regard to conflict-of-laws rules. Before filing any claim, you agree to contact us at support@oshaoperator.com and give us at least 30 days to resolve the dispute informally.

    16. Changes to these Terms

    We may update these Terms from time to time. The "Last updated" date at the top shows the current version. Changes apply going forward from the date they are posted; if a change is material, we will note it on this page. Continued use of the website after an update means you accept the revised Terms.

    17. Contact

    Questions about these Terms: email support@oshaoperator.com or use our contact form. Our US-based team answers 24/7 in English and Spanish.
